Drinking, smoking and drug laws in Georgia: what tourists need to know (ages, bans, fines, zero tolerance)

The short answer: Georgia’s drinking age is 18, alcohol is sold almost everywhere with few restrictions on public drinking, and the country has run a strict indoor smoking ban since 1 May 2018 that covers restaurants, bars and hotel common areas. Drug laws are among the toughest in the region for anything other than personal cannabis consumption, which a 2018 constitutional court ruling decriminalised in a narrow way that still trips up visitors who assume “decriminalised” means “legal to carry.” Drink-driving limits are low by Western European standards, and roadside checkpoints are routine on the same highways our tours use to Kakheti, Kazbegi and Batumi.

None of this should put you off Georgia’s wine culture, which is central to why many people visit in the first place. It does mean understanding the difference between social custom (the toasting table, the horn of chacha pressed into your hand at a supra) and the letter of the law, which is enforced unevenly in tourist areas but very seriously at borders, checkpoints and in any incident involving police. Because fines and thresholds are periodically revised by parliament, this guide gives the rules as they stand for 2026 and tells you exactly where to verify the current figures before you rely on them.

The drinking age and public drinking

The legal age to buy and consume alcohol in Georgia is 18. ID checks at shops, supermarkets and bars are inconsistent in practice, but the law applies to residents and visitors alike. Alcohol is sold in grocery stores, kiosks and wine shops at almost all hours in Tbilisi, Batumi and Kutaisi, with no nationwide curfew on off-licence sales, though individual municipalities can restrict hours near schools or during elections, so ask locally if you are unsure.

• Drinking on the street, in parks or at festivals is common and not treated as an offence in itself.
• Disorderly conduct or public intoxication that disturbs others can still draw an administrative fine under Georgia’s Code of Administrative Offences.
• Wine regions such as Kakheti build whole festivals around tasting, including the autumn Rtveli grape harvest, when our Rtveli — Wine Harvest in Kakheti tour and Kakheti Wine Country Day Trip both run alongside village cellar visits.

Smoking: the 2018 ban in restaurants, bars and hotels

Georgia’s Law on Tobacco Control has banned smoking in enclosed public spaces since 1 May 2018. This covers restaurants, cafes, bars, nightclubs, hotel lobbies and indoor common areas, offices, public transport, and medical and educational buildings. Covered outdoor terraces and purpose-built ventilated smoking rooms are sometimes exempted at the owner’s discretion, so look for signage rather than assuming either way.

• Fines apply to both venue operators who fail to enforce the ban and individuals who smoke in a banned area.
• Some hotels keep a small number of designated smoking rooms; ask at check-in rather than assuming your room allows it.
• Because penalty amounts are set by statute and occasionally revised, check the current text on Matsne, Georgia’s Legislative Herald before assuming a fixed figure.

Vaping and e-cigarettes

Amendments to the tobacco control framework extended most of the same indoor restrictions to e-cigarettes and vaping devices, along with an 18-plus sale rule and limits on advertising. In practice this means you should treat a vape the same way you would a cigarette indoors: step outside or to a designated area. Bringing a personal vape device and a reasonable quantity of e-liquid into Georgia for your own use is not unusual, but if you are carrying a large stock for resale or a device that uses nicotine salts restricted elsewhere, check current import rules via gov.ge or your embassy before you fly.

Drugs: zero tolerance, the cannabis exception, and penalties

Georgia operates a zero-tolerance regime for controlled substances. Possession, purchase, transport, cultivation or sale of drugs such as heroin, cocaine, MDMA or amphetamines carries severe criminal penalties, up to and including lengthy imprisonment, and there is no informal small-quantity exemption at the border or at a police checkpoint. Officers can request urine or blood tests, and refusal or a positive result outside the narrow exception described below can lead directly to prosecution.

The one significant nuance dates to a 2018 Constitutional Court ruling that found criminal punishment for personal consumption of cannabis unconstitutional, effectively decriminalising the act of using marijuana for oneself. This is routinely misreported as “marijuana is legal in Georgia,” which it is not in any practical sense for a visitor: buying it, possessing it in a public place, cultivating it, carrying it across any border, or driving after using it all remain offences. Tourists have been detained for assuming the ruling applies more broadly than it does, so treat cannabis exactly as you would any other controlled substance unless you have read the current law yourself.

• Verify the current statute and penalty ranges on Matsne before forming any assumptions.
• If you or a travelling companion is detained, contact your embassy immediately; the Georgian Ministry of Foreign Affairs publishes general visitor guidance at mfa.gov.ge, and your own country’s foreign ministry will have a Georgia-specific advisory.
• Never agree to carry a parcel, bag or “gift” across a border on someone else’s behalf.

Drink-driving limits and checkpoints

Georgia sets a low permissible blood alcohol level for private drivers, around 0.3 per mille (roughly 0.03 percent BAC), with a zero-tolerance 0.0 limit for professional, commercial and public transport drivers. Random breathalyser checkpoints operate on the main highways, including the routes to Kakheti’s wine villages, the Georgian Military Highway toward Kazbegi, and the Tbilisi–Batumi motorway. Because fines, point systems and licence-suspension rules are revised from time to time, check the current schedule on georoad.gov.ge rather than relying on an outdated figure.

If a day of tastings in Kakheti or Racha is part of your plan, hiring a car with an English-speaking driver removes the question entirely; our own drivers do not drink on duty, and the per-day rates are listed on our services page.

Chacha and the toasting table: etiquette, not obligation

Chacha, a strong pomace brandy that is often homemade and can run from roughly 40 to 60 percent alcohol by volume, is central to the Georgian supra, the long toasting dinner led by a tamada. Guests are not legally or socially obliged to finish every glass or horn. Saying that you are driving, placing a hand lightly over your glass, or taking a token sip during a toast is understood and accepted; what matters more to your hosts is participating in the spirit of the toast, not the quantity consumed.

• Pace yourself: homemade chacha strength varies enormously between villages and even between households.
• Eat as you go; Georgian meals are built around sharing food continuously through a long toasting session.
• On a guided wine experience such as Kakheti Grand Wine & Heritage or the Rtveli harvest tour, your guide can quietly manage the pace or substitute wine for chacha if you prefer.
• After any tasting, treat the drink-driving limit above as absolute and arrange alternative transport.

Practical summary

• Drinking age: 18, loosely checked but legally binding; public drinking is generally tolerated unless disorderly.
• Smoking banned indoors in restaurants, bars, hotels and public transport since 1 May 2018; outdoor terraces vary.
• Vapes and e-cigarettes follow the same indoor rules and an 18-plus sale age.
• Drugs: zero tolerance for everything except personal cannabis consumption, a narrow 2018 court exception that does not cover buying, carrying, public use or driving.
• Drink-driving limit is low (about 0.3 per mille for private drivers, zero for professionals); checkpoints are common on tourist routes.
• At a supra, declining chacha politely is accepted; a token sip during toasts is customary.
• Always verify current fines and thresholds on matsne.gov.ge, georoad.gov.ge or mfa.gov.ge before you travel, since figures change periodically.
